GENERAL

BY ORDERING GOODS FROM US YOU ARE DEEMED TO HAVE UNDERSTOOD AND ACCEPTED THESE TERMS

These General Terms and Conditions of Sales (hereinafter our “Terms”) set out the basis on which you can order products displayed for sale in our UK store situated at 52 Chiltern St, London W1U 7QU, or on our website located at https://sabre-paris.co.uk (or any subsequent URL which may replace it - our “Website”) and which are being delivered within the United Kingdom.

 

  • WHO WE ARE

SABRE PARIS Ltd (“we" or “us”) is a French designer and manufacturer of modern and elegant tableware, with a colourful twist! We are registered in England and Wales under company number 14681031 and have our registered office at 8th Floor South, 11 Old Jewry, London, United Kingdom, EC2R 8DU. 

You can find everything you need to know about us and our products on our Website or from our sales staff (if you are visiting our UK store) before you place an order.

  • YOUR ACCOUNT DETAILS WITH SABRE

If you choose to register a client account with us, you must ensure that your user identification code, password or any other piece of information we may require as part of our security procedures, is kept secure and treated as confidential. You must not disclose it to any third party.

You agree that any information you submit to the Website, including when you register on the Website, is true, accurate and not misleading. You agree that you will notify our customer service team of any changes to the information you provided when you register on the Website.

We have the right to disable any user identification code or password if in our reasonable opinion you have failed to comply with any of the provisions of these Terms.

 

  • PRODUCTS CAN VARY SLIGHTLY FROM THEIR PICTURES

 The images and packaging of the products on our Website are for illustrative purposes only. Indeed, a product's true colour or style may not exactly match that shown on your device (whether it is a phone, a tablet, a laptop, or your desktop) or in our printed brochures and other advertising, or its packaging may be slightly different.

We do not accept liability for limited discrepancies which may occur with respect to your order.

 If you are unhappy with your purchase, please see Section (M) ‘Returns and Refunds’ below.

 

  • PRODUCTS MAY NOT ALWAYS BE AVAILABLE

Products are subject to availability and products that are in your cart prior to you finalising your order are not reserved to you, and can be purchased by other customers. We will do our best to remove any products which have sold out at the earliest opportunity. However, as there is a delay between the time when your order is placed, and the time when the order is accepted, the stock position relating to a particular product may change.

If a product you have ordered becomes out of stock after we have accepted your order, then we will not be liable to you for being unable to provide that product. If such a situation arises, then we will cancel your order of the out of stock product and you will not be charged for it.

 

  • PLACING AN ORDER ON OUR WEBSITE

You can place an order with us online following the steps set out below:

  1. After choosing your favourite products from our Website, select the desired quantity of products and click on “ADD TO CART”.
  2. Click on “GO TO CART’ once you are ready to finalise your order.
  3. Please check that you are ordering the correct items in the desired quantity before finalising your order.
  4. If needed, don’t worry, you can always remove and/or add items to your cart!
  5. Before placing your order, you must ensure that you have read these Terms by ticking the box “I accept the General sales conditions”.
  6. Click on "CHECKOUT".
  7. If you already have an account with us, you can log into it and use your pre-recorded information to finalise your order.
  8. In you don’t have an account with us, fill in your contact information and shipping address allowing us to proceed with your order.
  9. If you have a gift card or a voucher code, it’s time to let us know!
  10. Choose your Delivery method (standard or, if available, ‘Click & Collect’)
  11. Click on “CONTINUE TO SHIPPING”.
  12. Fill in you billing details and the method of payment and click on “PAY”.
  13. Congratulations, you’re all set! We will send you an Order Confirmation email. We cannot wait for you to enjoy our gorgeous cutlery. Please note that this email is an acknowledgement that we have received your order but it is not an acceptance of your order, which is subject to Section (H)

 

  • ORDER ACCEPTANCE

We are deemed to have accepted your order only when (i) we have sent you an email confirming that the products have been dispatched from our warehouse; or (ii) where you have selected a ‘Click and Collect’ delivery option in accordance with Section (L) below, we have sent you an email confirming that the products are ready to be collected.

 

  • PRICE AND PAYMENT

Currency: The price of our products is the price indicated in Pound Sterling on the relevant product page of our Website when you place your order. All prices displayed on our Website are the price for the products only, they do not include charges for delivery, if any. Prices include VAT or other sales taxes payable, unless otherwise specified.

VAT: If the rate of VAT changes between your order date and the date we supply the product, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.

Error in our pricing: We use all reasonable efforts to ensure that all pricing information on our Website is correct. Occasionally, however, an error may occur and products may be mispriced. If this pricing error is identified before your order is accepted, we will cancel your order and you will not be charged. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may refund you any sums you have paid and require the return of any goods provided to you.

Payment methods: the payment methods that we accept are detailed in our online ordering process on our Website. We may change the payment methods that we are able to accept at any time. We are not responsible for any charges or other amounts which may be applied by your card issuer or bank or payment method provider as a result of our processing of your credit/debit card payment or other payment method in accordance with your order.

Charging you for your order: We will take payment for your order only when your order has been accepted and we have emailed you to confirm that your products have been dispatched. If you have paid by credit or debit card, after you place your order in accordance with Section (G) we will pre-authorise your payment method up to the value of your order. This pre-authorisation may appear on your bank statement. However, we have not taken any payment from you at this point. In the event of any order cancellation, the authorisation will be released and you will not be charged.

 

  • INSTANCES WHERE WE MAY REJECT ORDERS

Even though we strive for impeccable client services, sometimes we may find ourselves in a position to have to reject your order.

This may happen, for example, because, at the time of placing your order: 

  • a product is unexpectedly out of stock or no longer sold; or
  • we could not obtain authorisation for your payment; or
  • you are located outside our delivery areas, as stated on our website; or
  • you have placed an order for multiple quantities of a particular product, where such products are to be shipped to any one delivery address; or
  • the delivery address you have provided is not a valid shipping address; or
  • the product was mispriced by us.

When this happens, we will inform you in writing that your order has been cancelled and we will not charge you for the product.

Delivery occurs (i) on the day on which you receive the goods or services at the address you have indicated for delivery at time of placing your order; or, if available, (ii) on the day you collect it from us using our Click and Collect service (“Delivery”).

Any claim regarding a package that has not been received, has been lost, or contains a missing item must be submitted to customer service within 30 days of the delivery date indicated by the carrier.
After this period, no claims will be accepted, unless otherwise required by law.

Free Delivery: Delivery is free for orders amounting to £100 or more. Our ‘Click & Collect’ service, when available, is also free.

Estimates only: Notwithstanding the different delivery options that are available to select, the delivery periods stated are estimates only. Please note that the delivery of your order may take longer during sales or other busy periods.

Your delivery information: You must provide us with complete and accurate recipient and delivery address information. WE WILL NOT BE LIABLE FOR ANY ISSUES WITH THE DELIVERY OF YOUR ORDER AS A RESULT OF YOU SUPPLYING US WITH INCOMPLETE OR INACCURATE DELIVERY INFORMATION.

Products in instalments: we shall be entitled to supply our products from one order in instalments. This may mean that products within an order are dispatched or made available for collection separately and/or at different times.

Third party couriers: Deliveries will be fulfilled by third party couriers on our behalf. By placing an order for delivery on our Website, you agree to the conditions of carriage of our delivery partners. In certain circumstances, our delivery partner may offer you alternative delivery options, such as leaving the parcel with a neighbour, or in a safe place on your premises. IF YOU SELECT TO RECEIVE YOUR ORDER VIA ONE OF THESE OPTIONS, YOU ACKNOWLEDGE AND AGREE THAT WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGE THAT MAY RESULT FROM THIS SELECTION.

Tracking your order: You can track and view online orders via your account page on our Website.

Risks pass on Delivery: A product will be your responsibility from the day of Delivery. This means that the risk of damage to, or loss of, the product is yours from that point. You will own a product once we have received payment in full.

 

  • CLICK AND COLLECT FROM OUR UK STORE

We offer a ‘Click and Collect’ service for you to collect the order you have placed on our Website from our store located in the UK. 

We will send you an email notifying you when your order is ready for collection. You must bring your order confirmation and a valid form of ID (payment card, passport or driving licence) to collect your order.

We will keep your order for fourteen (14) days at the collection point (unless we have expressly agreed otherwise with you), after which it will be returned to our warehouse and your order will be cancelled and refunded if it has not been collected.

 

RETURNS & REFUNDS

  • Our returns policy: Subject to section (O) below, products may be returned for a refund within 30 days of Delivery, provided that they comply with this policy.
  • Exceptions: Please note that we will not accept returns or cancellations in respect of goods that are tailor made to your specifications or are clearly personalised. This doesn't affect your statutory rights if goods are faulty as described in Section (N)
  • How to return your product:
  • In-store returns: you can either bring the relevant product to one of our stores providing our staff with the email receipt of your order and the card you paid with.
  • Online returns: You can request a return by filling our online form accessible here : https://sabre-paris.co.uk/pages/returns
  • Postal returns: alternatively, you can send the product back to us, using an established delivery service. If you do this, you should keep a receipt or other evidence from the delivery service that proves you have sent it and when you sent it. If you don’t do this and we don’t receive the goods at all or within a reasonable time we won't refund you the price. For help with returns, please reach out to our customer service team at the details provided at Section (C) above.
  • When and how we refund you: Refunds will be made back to your original payment method within 14 days of us receiving the returned goods, provided that they comply with this policy. If a promotional discount was applied to your order, the same discount will be applied when calculating your refund, such that the amount refunded will reflect the actual price you paid for the goods.
  • Refund on delivery costs: We only refund standard delivery costs. We don't refund any extra you have paid for express delivery or delivery at a particular time.
  • Circumstances which may affect your refund: All products must be returned in their unused, original condition, with unopened product packaging and any tags attached and seals unbroken. If you have used or damaged a product, or if you handle the product in a way which would not be acceptable in-store, we reserve our rights to reduce the amount of your refund, to compensate us for its reduced value.

 

For example, we may reduce your refund if:

  • the product's condition is not "as new"; or
  • price tags have been removed; or
  • the packaging is damaged or;
  • parts of the product are missing.

 

In some cases, no refund may be due at all if the damages caused to the products are too significant. 

Please liaise with our customer service team at the details provided at Section (C) above for advice on whether we're likely to reduce your refund.

 

  • YOUR CANCELLATION RIGHTS

Our returns policy above does not affect your statutory rights as a consumer, including, where applicable, your right to cancel an order placed on the Website within 30 days of receipt of your order and your rights in respect of faulty or defective goods.

 

Your cancellation rights – Online purchase only

Subject to Section (O) below, if you have bought one of our products online via our Website, you have a legal right to change your mind about your purchase and receive a refund of what you paid for it, including standard delivery costs. This is subject to some conditions, as set out below:

  • Our cancellation policy. We offer our UK customers a cancellation policy for our products bought online which is more generous than your legal rights in the ways set out below.

30 days to change your mind

30 days starting from the day after Delivery has occurred, , which represents an additional sixteen (16) days beyond the statutory withdrawal period  (“Cancellation”).

Return of the products must occur within 14 days from the date of Cancellation.

 

  • How to exercise your cancellation rights: you can let us know that you have changed your mind no later than 30 days from the day after Delivery has occurred, by contacting our customer service team at the details provided at Section (C) above.

 

IF YOU DECIDE TO CANCEL, YOU MUST RETURN THE PRODUCTS TO US WITHIN 14 DAYS OF THE CANCELLATION DAY IN ACCORDANCE WITH SECTION (M) ABOVE.

 

  • When and how we refund you: we will reimburse you the amount in relation to goods to which your cancellation rights apply by the method used to pay for the original transaction:
    • If your product hasn’t been delivered at time of cancelling: we will refund you as soon as possible and within 14 days of you telling us you've changed your mind.
    • If your product was already delivered at time of cancelling and you are sending it back to us: we will refund you within 14 days of receiving the product back from you, provided it complies with our returns policy at Section (M) We will send you a confirmation email at the address you have provided us once we have received your product.

 

Your rights in respect of faulty or defective goods.

If you think there is something wrong with your product, you must either bring it into one of our stores (to find the nearest SABRE store next to you, please follow this link on our website), or contact our customer service at the details provided at Section (C) above.

We honour our legal duty to provide you with products that are as described to you on our Website and that meet all the requirements imposed by law. Your legal rights are summarised below. These are subject to certain exceptions. For detailed information please visit the Citizens Advice website www.citizensadvice.org.uk

 

  • CUSTOMISED GOODS 

Return: Please note that in accordance with Regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013/3134, we will not accept returns or cancellations in respect of goods that are tailor made to your specifications or are clearly personalised. This doesn't affect your statutory rights if goods are faulty as described in Section (N) above.

 

Cancellation: Once your order for customised goods has been confirmed, cancellations will not be accepted, and any payment made is non-refundable, except in cases where we are unable to fulfil your order in accordance with the agreed specifications.

 

  • OUR RIGHTS

We can limit the number of a given item that can be bought by each individual customer should we deem it appropriate.

We can suspend your account if we notice an unusual pattern of returns activity or there is other suspicious activity associated with your account. In the event that this happens, we will send you an email notifying you.

We can suspend the supply of a product to deal with technical problems or changes in relevant laws and regulatory requirements; or

We can make changes to a product, for example to reflect changes in relevant laws and regulatory requirements, or to make technical adjustments and improvements; or

We may amend these Terms from time to time. Every time you wish to buy our products, please check these Terms to ensure you understand the terms that apply at that time.

 

  • YOUR PERSONAL DATA

By placing an order on our Website, you understand and agree that we may collect, use, store and process your personal data in accordance with our Privacy & Cookies Policy.

  • FORCE MAJEURE

If our supply of your product is delayed by an event outside our control, such as an event of force majeure, we will endeavour to contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. As long as we do this, we won't compensate you for the delay, but if the delay is likely to be substantial you may contact our customer service team at the details provided at Section (C) above to cancel your order and receive a refund for any products you have paid for in advance, but not received.

 

  • OUR LIABILITY TOWARDS YOU

We are responsible to you for foreseeable loss or damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

WE WILL NOT BE HELD RESPONSIBLE FOR ANY DELAY OR FAILURE TO PERFORM OR COMPLY WITH OUR OBLIGATIONS UNDER THESE TERMS IF THE DELAY OR FAILURE ARISES FROM ANY CAUSE WHICH IS BEYOND OUR REASONABLE CONTROL, SUCH AS FORCE MAJEURE.

WE ARE NOT LIABLE FOR BUSINESS LOSSES. WE ONLY SUPPLY THE PRODUCTS FOR DOMESTIC AND PRIVATE USE. IF YOU USE THE PRODUCTS FOR ANY COMMERCIAL OR BUSINESS PURPOSES WE WILL HAVE NO LIABILITY TO YOU FOR ANY LOSS OF PROFIT, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR LOSS OF BUSINESS OPPORTUNITY.

In this respect, any order for products made by a business entity must be placed through our BtoB Platform JOOR.

WE DO NOT EXCLUDE OR LIMIT IN ANY WAY OUR LIABILITY TO YOU WHERE IT WOULD BE UNLAWFUL TO DO SO. THIS INCLUDES LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR THE NEGLIGENCE OF OUR EMPLOYEES, AGENTS OR SUBCONTRACTORS; FOR FRAUD OR FRAUDULENT MISREPRESENTATION; OR FOR BREACH OF YOUR LEGAL RIGHTS IN RELATION TO THE PRODUCTS YOU PURCHASE FROM US.

 

  • DISPUTES AND GOVERNING LAW

In the event that you are experiencing issues with our products, please contact our customer service team at the details provided at Section (C) above: we will do our best to resolve any problems you have.

If, despite our best efforts, you are still unsatisfied, you can go to court. These Terms are governed by English law and you, and we, hereby submit to the non-exclusive jurisdiction of the English courts. This does not affect your legal rights as a consumer in the country or region in which you are located.

 

  • TRANSFERRING THIS CONTRACT

We can transfer our contract with you, so that a different organisation is responsible for supplying your product. We'll tell you in writing if this happens and we'll ensure that the transfer won't affect your rights under the contract.

 

  • INTUITU PERSONAE 

This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

 

  • ENFORCEABILITY

Even if we delay in enforcing this contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.
